Bar incident leads to battery arrest

A 24-year-old man was arrested Sunday by Fayetteville police on a probable charge of seconddegree battery, accused of punching another man outside a Dickson Street bar, causing him to hit his head on pavement and sending him to the hospital.

Tim Horne, no age or address provided by police, was listed in fair condition Monday night, according to a spokesman with Washington Regional Medical Center, where Horne was taken by ambulance after the incident Sunday.

John Patrick McCormack, 24, of 970 W. Berry St. in Fayetteville was arrested by Fayetteville police following the incident.

Police officers responded to Mickey Finn's Irish Pub, 644 W. Dickson St., at about 11:45 p.m. Sunday in reference to a disturbance. The dispatcher told them that an intoxicated person, later identified as McCormack, spat on and tried to punch the bouncer. Central EMS was also called to attend to Horne, according to the police report.

A police officer who arrived on the scene was led to the area of Gregg Avenue and Lafayette Street, where he saw two witnesses pointing to McCormack, who was running east on the sidewalk of Lafayette Street Bridge, according to the police report.

McCormack was "very unsteady" on his feet due to his level of intoxication, according to the police report.

McCormack told the officer that he was running because people were trying to start trouble with him. He was then arrested for public intoxication and taken back to Mickey Finn's. He was vague about his involvement but denied spitting on or striking anybody, according to the report.

Two other officers spoke to witnesses and the two victims. McCormack was identified as the person who spit on the bouncer and punched Horne, who was bleeding from his ear and nose, according to the police report.
